Mediation

We offer Mediation Services to assist parties in coming to a cost effective and timely settlement of Estate Litigation Issues.  

Mediations are conducted by Colleen Feehan, J.D., B.A.

We can accommodate mediations for the following types of litigants: 

• Parties each represented by Counsel
• Families looking for mediated solutions on complicated estates

Types of Issues we Mediate: 

• Conduct of Executors/Personal Representatives
• Family Maintenance and Support Claims 
• Will Challenges
• Conduct of Powers of Attorney and Personal Directive Agents
• Trust Variations or Terminations
• Undue Influence or Incapacity 
• Passing of Accounts

Process: 

• Each party will submit brief written materials setting out the issues to be reviewed
• The Parties will attend in person or remotely
• During the Parties attendance the following may occur: 
  • The Parties will be assured of their voluntary participation and the confidential nature of all discussions;
  • The position of each party will be disclosed to the other party
  • An objective and unbiased review of the strengths and weaknesses of each party’s position will be provided
  • The parties alternatives to mediation will be discussed 
  • Discussions on possible solutions will commence with the intention of coming to a mutually acceptable agreement  

Colleen Feehan is a Harvard Law School Trained Mediator who has been practicing in Wills and Estate for over a decade.
